The Arlington-based language learning companyh said in announcing its legalk action that a June 2009 policy changse byMountain View's Google (NASDAQ:GOOG) that woulr allow advertisers in its Adwordf advertising program to use trademar k terms in ad text even if they do not own the trademarki or have explicit approval from the owner to use it is behinds the suit. “Google’s search engine is helping thirde parties mislead consumers and misappropriate Rosettw Stone trademarks by using them as triggers for paid advertisements and by usinf them within the text or title ofpaid advertisements,” said Rosettaq Stone’s general counsel Michaek Wu.
“Google and its advertisers benefit financially from and tradwe off the goodwill and reputation of Rosettas Stone without incurring the substantial expensde that Rosetta Stone has incurred in building up its name recognition, and brand loyalty,” Wu Rosetta Stone (NYSE:RST) said it is is seekiny injunctive relief to prevent Googlse from selling the Rosetta Stonwe trademarks or other terms confusingly similafr for use in Google’s Adwords advertising program. The case was filed in the U.S. Districtf Court for the Eastern Districtof Virginia.
